Many international courts have developed into institutions of public authority; this begs the question of their legitimation. This Article addresses their democratic legitimation and argues that Articles 9-12 of the E.U. Treaty provide a promising blueprint for its conceptualization, fusing theories focused on representation, participation and deliberation. This fusion points the way towards conceiving and developing the democratic credentials of institutions beyond the state in general. This article examines the clergy sexual abuse crisis in the Roman Catholic Church from an ethical point of view. The article uses the RRICC values model of ethical decision making (i.e., responsibility, respect, integrity, competence, concern) to review the behavior of Catholic bishops and other religious superiors as they have tried to manage clergy sex offenders and their victims. Hopefully, the recent press attention and resulting policy changes on these matters from the U.S. Council of Catholic Bishops will increase the (...) chances that future decisions will be ethical ones. By Armin Münch. Münster, Hamburg, London: LIT-Verlag, 1998. 337 pp. This is a most unusual study, pieced together out of hidden facets and neglected aspects of Buddhist and Christian studies and containing an (...) unrivaled overview of the literature. If modernWestern theology, taking its cue from Heidegger, has emphasized the temporality of existence, Münch draws our attention to its "spatiality" in what he calls "dimensional thinking." He is able to point to an astonishing number of thinkers from a variety of disciplines who have taken as their starting point our need to orient ourselves in space. In this light, the kenôsis.assage Philippians 2:5-11 is seen to be patterned on a U-shaped movement linking the dimensions "above" and "below" as distinct from S- and O-shaped movements found elsewhere in the mystical tradition.Münch goesonto establish left/right, behind/before, inside/outside, coming to be/passing away as what he calls "immanentals" (12-13) analogous to the "transcendentals" of scholastic theology. In particular, he seeks out thinkers who have tried to formulate the "fourth dimension," which would take us beyond conventional space-time. Plotinus, Eckhart, and the Kabbala are all examined for their attempts to conceptualize the transcendent in this way.What is the purpose of this exercise? Münch's leading question, to which he eventually returns, is clear: "What is lacking in our idea of God if we are ignorant of Buddhist experience?" (5). His purpose is to evaluate the relative significance of kenôsis ("he emptied himself") and tapeinosis."he humbled himself") in Philippians 2. This becomes apparent when he comes to the leading thinkers of the Kyoto School--Nishida, Nishitani, and Abe--and the debate between Takizawa and Yagi. Here Münch finds evidence of a "backwards-directed," or "dorsal," theology that corresponds to a rearwards movement in Buddhist thinking (264). This interesting hypothesis would need further verification by consulting the textual and extratextual traditions that shaped Japanese Buddhism in the context of their Indian and Chinese origins. In criticizing the work of Perry Schmidt-Leukel, Münch suggests that for Buddhists the balance between the experiences of relationship and transitoriness is not so much a matter of different directions or perspectives of transcendence as a leaving behind of all perspectivity (130-133). The search for salvation is orientated rearward in the Buddhist case, forward in the Christian, but these can be seen as complementary directions on the one road.Münch is able to agree with Ueda that Buddhist "nothingness" is best understood as a "desubstantializing dynamic" (283-284). Shûnyatâ.s the "fullness of nothingness" corresponds to the Christian concept of God. Christ is said to have "gone outside himself" rather than to have "emptied himself out" ["Christus entäusserte sich, aber er entleerte sich nicht!"(287)], to have undergone a metamorphosis. In Münch's view, only trinitarian language can encompass all the dimensions, from zero to the [End Page 139] elusive fourth, which are necessary to express what we mean by God in Buddhist terms (305-306).One of the most original things Münch does is to draw a parallel between the Zen ox-herding pictures and the Christian story. This serves to draw together pictorially, if not conceptually, the sometimes arcane researches that go to make up Münch's mosaic. It is perhaps because spatially dimensional thinking has been so rare in Western science, philosophy, and theology that he must search in such dark corners for evidence of it. The result is an at times bewildering patchwork of apparently unrelated contributions that do not blend smoothly into a unity. Reincarnation is a death-specific and forward-looking philosophico-religious phenomenon that enjoys a cross-cultural appeal. It represents the theory that when the soul separates from the body at death, it informs another body for another round of earthly life. The debate on reincarnation has, so far, revolved around the reality or otherwise of reincarnation and the associated claims. In this article, we undertake a holistic and critical examination and appraisal of the key arguments underlying the reincarnation debate, with emphasis on the nature (...) and structure of reincarnation, as well as the value of reincarnation belief. The aim is to determine who gets what among the contending parties. Although oral interviews were involved in the exercise, textual and doctrinal analysis of extant literatures on reincarnation formed the predominant source of data for the research. Our finding reveals that although the phenomenon of reincarnation is bedeviled by internal contradictions and belief in it hardly justifiable, belief in it has some positive values, including coping and unifying values that could be harnessed for the well-being of people and society. These observed values of reincarnation and the attendant belief in it, the article concludes, do not constitute a conclusive proof of the reality of reincarnation.Contribution: The contributive value of this paper lies in bringing to the fore the fact that contrary to popular assumption, the notion of belief is in reality, epistemically more powerful than knowledge, at least in the context of religion. Considering that HTS Theological Studies focuses on religious issues and that ‘belief’ and ‘knowledge’ are religious concepts, we consider this paper to be suitable to its objectives. (shrink)

A pure probabilistic approach to Gibbs' distributions is given, starting from the notion of “finite exchangeable random process.” The differences between bosons, fermions, and classical particles are ascribed to different values of correlation. The relationship between exchangeability and constraints on the energy distribution is investigated.

Dai Zhen’s philosophy of language took the opportunity of a transition in Chinese philosophy to develop a form of humanist positivism, which was different from both the Song and Ming dynasties’ School of Principles and the early Qing dynasty’s philosophical forms. His philosophy of language had four primary manifestations: It differentiated between “names pointing at entities and real events” and “names describing summum bonum and perfection”; In discussing the metaphysical issue of “the Dao,” it was the first to introduce a (...) syntax analysis of linguistics, clearly differentiating between the different roles of predicate verbs “zhi wei” and “wei zhi” in Classical Chinese; In criticizing Confucian thought during the Song and Ming dynasties, it adopted specific philological skills such as the analysis of phraseology, the meaning of sentences and the thread of words in texts; and It re-interpreted the meaning of Confucian classics by studying characters and language, adopting a positivist and philological manner to seek metaphysical sense in philosophy. In this way, his philosophy was different from the scholars of the School of Principles during the Song and Ming dynasties and from the goal of Western linguistic philosophy in the 20th century, which refuted metaphysics. Accordingly, it helped to develop 18th century Chinese philosophy as it turned towards linguistic philology. (shrink)
